These Terms and Conditions ("Terms") govern your use of the website and online store operated by **Welby & Wright** ("we", "us", "our"), owned and operated by **Craig Peebles**. By accessing our website, purchasing products, or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our website.

These Terms are governed by the laws of **Scotland** and are drafted to comply with **UK consumer law**, including the Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and related legislation.

2. Eligibility and Use of the Website

You must be at least 18 years old or have the permission of a legal guardian to place an order. By using this website, you confirm that you have the legal capacity to enter into a binding contract under Scots law.

You agree not to:

* Use the website for any unlawful purpose

* Attempt to gain unauthorised access to the website or its systems

* Interfere with the website’s security or functionality

* Copy, reproduce, distribute, or exploit website content without our prior written consent

We reserve the right to suspend or terminate access to the website where misuse is suspected.

3. Products and Descriptions

Our products consist primarily of **handmade ceramic art tiles and related items**. Due to their handmade nature:

* Variations in colour, glaze, texture, size, and finish are inherent and are **not defects**

* Product images are representative only and may differ slightly from the final item

All product descriptions and prices are subject to change. While we take reasonable care to ensure accuracy, errors may occur.

4. Pricing and Payment

All prices are shown in GBP (£) unless stated otherwise and are inclusive of VAT where applicable.

We reserve the right to amend pricing at any time. Payment must be made in full at checkout using the available payment methods.

If a pricing or payment error is identified, we reserve the right to cancel the order and issue a full refund.

5. Shipping and Delivery

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by couriers, customs processes, or events beyond our reasonable control.

Risk of loss or damage passes to you upon delivery to the address provided, subject to your statutory rights under UK consumer law.

6. Liability & Installation Disclaimer

Ceramic tiles are inherently fragile and may be heavy. By purchasing and installing our ceramic art tiles, you acknowledge and agree that:

* Proper installation is the responsibility of the customer or their chosen installer.

* We are not responsible for damage to walls, floors, fixtures, fittings, furniture, or other property resulting from improper handling, installation, mounting methods, substrates, adhesives, anchors, or environmental conditions.

* We are not liable for incidental or consequential damage arising from a tile falling, shifting, or detaching after installation, including damage to internal fixtures or fittings within a customer’s property.

* Where tiles are displayed using a supplied wooden easel, the easel is provided for **decorative display purposes only**. We accept no liability for damage or injury resulting from tiles tipping, falling, or being knocked from the easel.

* Customers are responsible for placing easel-displayed tiles on stable, level surfaces and away from edges, children, pets, and high-traffic areas.

We strongly recommend that all ceramic tiles are installed by a qualified professional and in accordance with industry best practices.

Nothing in this section limits or excludes liability where it would be unlawful to do so under UK law.

7. Returns & Refunds Policy

7.1 Consumer Rights Notice (UK)

Under the Consumer Contracts Regulations 2013, customers purchasing online normally have a 14-day cancellation right. **However**, this right does **not** apply to:

* Custom-made or personalised items

* Goods that are liable to deteriorate or are made to order

Where applicable, your statutory rights are not affected by this policy.

7.2 Returns Eligibility

Due to the handmade and fragile nature of our **ceramic art tiles**, returns are limited and subject to the following conditions:

* Return requests must be submitted within **48 hours of delivery**

* Items must be **unused, uninstalled, and unaltered**

* Items must be returned in their **original packaging**, including all protective materials

* Proof of purchase is required

The following items are **not eligible for return**:

* Custom, made-to-order, or personalised tiles

* Installed tiles or tiles showing signs of use or modification

* Seconds, samples, artist proofs, or clearance items (unless damaged in transit)

* Gift cards or digital products

Natural variations in colour, glaze, texture, size, or surface detail are inherent to handmade ceramics and are **not considered defects**.

7.3 Damaged or Defective Items

If your order arrives damaged or defective, you must notify us within **48 hours of delivery** and provide:

* Your order number

* A description of the issue

* Clear photographs of the item, packaging, and shipping box

Once verified, we may offer at our discretion:

* A replacement (subject to availability)

* A refund

* Store credit

Claims submitted outside this timeframe may not be eligible.

7.4 How to Start a Return

2. If approved, we will provide return authorisation and instructions

3. Securely package the item using the original packaging and ship as directed

Unauthorised returns may be refused.

7.5 Return Shipping & Packaging

* Customers are responsible for return shipping costs unless the item was damaged or defective

* Returned ceramics must be packed with adequate cushioning

* We are not responsible for damage caused by improper return packaging

Original shipping fees are **non-refundable**, except where required by law.

7.6 Refunds

Approved refunds will be issued to the original payment method. Please allow up to **7 business days** after approval for processing.

Refunds may be reduced or refused if returned items show signs of use, installation, or damage unrelated to transit.

7.7 Replacements & Exchanges

Due to the limited and often one-of-a-kind nature of our products:

* Exchanges are generally not available

* Replacements are offered only for damaged or defective items and are subject to availability

If a replacement is unavailable, a refund or store credit will be issued.

7.8 International Orders

For international orders:

* Customers are responsible for return shipping, customs duties, taxes, and import fees

* Original shipping costs, duties, and taxes are non-refundable

* Replacement availability cannot be guaranteed

8. Intellectual Property

All website content, designs, text, images, and logos are the intellectual property of Welby & Wright or its licensors. Unauthorised use is prohibited.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the website and products are provided on an "as is" and "as available" basis. We make no guarantees that the website will be uninterrupted or error-free.

10. Limitation of Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

Subject to the above, Welby & Wright and Craig Peebles shall not be liable for indirect, incidental, or consequential losses, and total liability shall not exceed the amount paid for the product giving rise to the claim.

11. Indemnity

You agree to indemnify and hold harmless Welby & Wright and Craig Peebles from claims arising from your misuse of the website, breach of these Terms, or improper installation or handling of products.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of **Scotland**, and the Scottish courts shall have exclusive jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the website constitutes acceptance of the revised Terms.
